Spaced Art LLC ("Spaced Art," "we," "us," or "our") operates the spaced.art platform. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our website and services. It also describes your rights under applicable law, including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).
Please read this policy carefully. By using our Service, you agree to the practices described here.
Account information: Name, email address, and password when you create an account.
Order information: Shipping name, mailing address, and email address when you place an order.
Communications: Any messages you send us via email or contact forms.
Room photographs (optional): If you choose to upload photos of your space to personalize your art, those images are processed as described in Section 3.2. They are not retained.
Wallet information (optional): If you transfer your authenticity NFT to an external wallet, you may provide us with the destination wallet address. We do not request or store private keys, seed phrases, or any credentials granting access to external wallets.
When you use our platform, we automatically collect certain technical information, including:
IP address and general geographic location (city/region level)
Browser type and version
Device type and operating system
Pages visited, time spent, and clickstream data
Referring URLs
Session and interaction data
This information is collected through standard web technologies including cookies, pixels, and analytics tools.
We may receive information from third parties, such as:
Stripe: Transaction status and fraud signals (not full card details)
Production partners: Order fulfillment and shipment tracking information
Analytics providers: Aggregated behavioral and engagement data
Blockchain infrastructure providers: Confirmation of NFT minting, transfer status, and on-chain transaction data
Processing and fulfilling your orders
Creating and managing your account
Sending order confirmations, shipping updates, and transactional communications
Providing customer support
If you upload photographs of your space, those images are used solely to derive a vector embedding — a mathematical representation of spatial and aesthetic features in your room — which is used to personalize art recommendations for you. The original photograph is deleted following this processing and is not stored, shared, or used for any other purpose. Only the derived embedding data is retained, and it is associated with your account for the purpose of personalization.
We may use anonymized data — including aggregated usage patterns, design interaction data, and generated artwork — to improve our services, develop new features, and train and refine our design systems. This data does not identify you personally. We will not use your room photographs for this purpose, as they are deleted following embedding extraction.
With your consent where required by law, we may send you promotional emails about new products, features, and special offers. You may opt out of marketing communications at any time by clicking the "unsubscribe" link in any marketing email or by contacting us directly. Transactional emails (order confirmations, shipping notices) are not subject to opt-out.
We may use your information to comply with applicable laws, respond to legal processes, enforce our Terms of Service, protect the rights and safety of our users and the public, and detect and prevent fraud.
When you purchase artwork, we mint a non-fungible token (NFT) on a public blockchain that serves as a proof of authenticity for your physical piece. The NFT is automatically generated and stored in a custodial wallet associated with your Spaced Art account. We use blockchain-related information solely to mint your NFT, display it within your dashboard, and process any transfer requests you initiate. You may transfer your NFT to an external wallet at any time. The NFT is not a license to reproduce the artwork and confers no copyright or commercial use rights. Spaced Art does not represent NFTs as investments or guarantee any monetary value.
We do not sell your personal information. We may share your information in the following limited circumstances:
We share information with third-party service providers who help us operate our business, including:
Stripe — payment processing
Production partners (e.g., Prodigi) — order fulfillment and printing
Cloud infrastructure providers — data storage and hosting
Email service providers — transactional and marketing communications
Analytics providers — product analytics and user behavior
Blockchain infrastructure providers — custodial wallet services, NFT minting, and blockchain network access
These providers are contractually required to use your information only as necessary to provide services to us and to maintain appropriate security.
We may disclose your information if required to do so by law or in response to valid legal process (subpoena, court order, etc.), or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
If Spaced Art LLC is involved in a merger, acquisition, asset sale, or similar transaction, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on our platform before your information becomes subject to a materially different privacy policy.
We may share your information for other purposes with your explicit consent.
NFTs minted on your behalf are recorded on a public blockchain. Once recorded, transaction data — including wallet addresses, mint timestamps, and transfer history — is publicly accessible and cannot be deleted or modified by Spaced Art or any other party. While wallet addresses are pseudonymous and not directly tied to your name in the public record, they may be linkable to you through other available information. By purchasing artwork, you acknowledge and consent to this public, permanent disclosure.
We retain your personal information for as long as necessary to fulfill the purposes described in this policy or as required by law:
Account information: Retained for the life of your account plus a reasonable period thereafter for legal and business purposes.
Order information: Retained for a minimum of seven (7) years for tax, financial, and legal compliance purposes.
Room photographs: Deleted immediately following vector embedding extraction. Not retained.
Vector embeddings: Retained for the life of your account to support ongoing personalization. Deleted upon account deletion.
Analytics and usage data: Retained in anonymized, aggregated form indefinitely.
Custodial wallet records: Retained for the life of your account. Upon account deletion, your custodial wallet is decommissioned and any NFTs remaining within it are either transferred to an external wallet you provide or, if no transfer destination is provided within a reasonable period, the wallet's contents may become inaccessible.
On-chain NFT data: Recorded permanently on the public blockchain and cannot be deleted, even upon account deletion or other privacy request. This is an inherent property of blockchain technology and outside our control.
We use cookies and similar technologies to operate our platform, remember your preferences, and analyze usage patterns.
Types of cookies we use:
Strictly necessary: Required for core platform functionality (session management, authentication).
Analytics: Help us understand how users interact with the platform (e.g., PostHog).
Marketing: Used to measure the effectiveness of our communications.
You can control cookie preferences through your browser settings. Note that disabling certain cookies may affect platform functionality. We honor browser-level "Do Not Track" signals where technically feasible.

Limits on deletion rights for blockchain data: Information recorded on a public blockchain — including NFT mint records, wallet addresses, and transfer history — is permanent and cannot be erased. We will honor deletion requests for all off-chain personal information we control, but cannot remove data from the blockchain itself. This is an inherent limitation of blockchain technology and applies to all users regardless of jurisdiction.
If you are a California resident, you have additional rights under the California Consumer Privacy Act and California Privacy Rights Act, including:
Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you in the past 12 months, as well as the categories of sources, purposes, and third parties with whom we have shared it.
Right to Delete: You may request deletion of personal information we have collected from you, subject to certain exceptions. Please note that information recorded on a public blockchain in connection with your authenticity NFT cannot be deleted; this is an inherent limitation of blockchain technology rather than a Spaced Art retention policy.
Right to Correct: You may request correction of inaccurate personal information.
Right to Opt Out of Sale or Sharing: We do not sell personal information and do not share personal information for cross-context behavioral advertising purposes.
Right to Limit Use of Sensitive Personal Information: We do not use sensitive personal information for purposes beyond those permitted by the CPRA.
Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.
Shine the Light: California Civil Code Section 1798.83 permits California residents to request information about our disclosure of personal information to third parties for direct marketing purposes. We do not disclose personal information for third-party direct marketing purposes.

Nevada residents may opt out of the future sale of their personal information. We do not currently sell personal information. To submit a request, contact us at privacy@spaced.art.
We implement commercially reasonable technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit (TLS), access controls, and secure cloud infrastructure.
No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach that affects your rights or interests, we will notify you as required by applicable law.
Custodial wallet security: We use industry-standard custodial wallet infrastructure to secure NFTs held on your behalf. Private keys are managed through our custodial provider and are not accessible to Spaced Art personnel. If you transfer an NFT to an external wallet you control, you become solely responsible for the security of that wallet, including private keys and seed phrases. Spaced Art cannot recover NFTs from external wallets.
Our Service is not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete that information promptly. If you believe we have collected information from a child under 13, please contact us at privacy@spaced.art.
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will notify you of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by email or a prominent notice on our platform. Your continued use of the Service after changes are posted constitutes your acceptance of the updated policy.
